(Depending on the severity, irresponsible driving can be an arrest-worthy offence in the UK, but it doesn't look like this guy actually was. He's been banned from driving for a year, fined £625 - around $1000 - and given 100 hours of community service.)

Oh, I see what you mean. I'm not sure the motorist in this case was arrested at any point - doesn't actually say so in the article - but it depends on how serious an offence the police perceived it as. Driving without due care and attention would typically see you pulled over and then summonsed by mail, rather than arrested. Dangerous driving typically gets you arrested.

As far as I know, in England and Wales you can actually be arrested for texting and driving, because that's taken very seriously here. Talking on the phone without a hands-free kit is taken a lot less seriously, so the police normally just hand out fixed penalty notices, but I believe you can get yourself arrested for it if you really insist on refusing the fixed penalty and make enough of a fuss.
